Terms of Service

These terms are the agreement between you and MarkKings Group LLC (“we”) for your use of Kivoo Apply(the “Service”). By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.
1. What the Service does
Kivoo Apply helps you find jobs, tailors your resume and cover letters using AI, drafts recruiter outreach and interview preparation, and can complete and submit job applications on your behalf to third-party application systems.
The last part matters most. When you approve a submission, the Service fills in and submits an application form to an employer or an applicant tracking system in your name, using the contact details, work history and answers held in your account. That employer receives it as an application from you, not from us.
2. Your approval is required before anything is sent
No application is submitted to a third party without your explicit approval of that specific application. The Service performs a series of automated safety checks before an application can be approved, and it refuses to submit when a check fails: when the resume file is missing, when the application form could not be found or read, when required questions are unanswered, or when the target page does not match the job it claims to be.
These checks reduce mistakes. They do not eliminate them. You are responsible for reviewing what you approve.
3. Your responsibilities
- Accuracy. Everything you upload (resume, work history, answers to screening questions) must be true. The Service is instructed not to invent employers, titles, dates, metrics or qualifications, and flags gaps rather than filling them. It cannot verify that what you gave it is true.
- Eligibility. You must be at least 18 years old and legally able to enter this agreement.
- Your account. Keep your password and any multi-factor credentials secret. Activity under your account is treated as yours.
- Third-party rules. Employers, job boards and applicant tracking systems have their own terms. You are responsible for complying with them. We do not submit to sources whose terms forbid automated submission, and the Service is configured to decline those sources, but the obligation is ultimately yours.
4. What you may not do
- Submit applications containing statements you know to be false.
- Apply on behalf of anyone other than yourself, or create accounts for other people without their consent.
- Use the Service to send unsolicited bulk messages to recruiters or anyone else.
- Attempt to bypass the approval gate, the rate limits, or the usage quota.
- Resell, sublicense or provide the Service to third parties as your own.
- Attempt to access another user’s data, or to disrupt or probe the Service’s infrastructure.
5. AI-generated content
Resumes, cover letters, outreach messages and interview notes are produced by large language models operated by third parties. Model output can be wrong, awkward, or subtly inaccurate about your own background, and two runs on the same input can differ. Review every document before you approve it. You own what you send; we do not warrant that generated content is accurate, complete, or suitable for any particular application.
As between you and us, you own the content you provide and the documents generated from it. You grant us the licence needed to operate the Service: to store your content, send it to the AI providers listed in our Privacy Policy, and submit it to the employers you approve.
6. Usage limits
Each account has a ceiling on AI usage, measured over a rolling 24-hour window in both number of requests and provider cost. When you reach it, generation is refused with a message saying which limit was reached, and it resumes as the window rolls forward. Limits may be changed, and paid plans may carry different ones.
7. No guarantee of a job
We do not promise interviews, responses, or employment. We do not control whether an employer reads, responds to, or acts on an application. Nothing in the Service is legal, immigration, or career advice.
8. Availability and changes
The Service is provided as-is and as-available. It depends on third-party AI providers, job boards and applicant tracking systems, any of which can change, rate-limit us, or go down. We may modify or discontinue features. If we make a material change to these terms, we will update the effective date above and notify registered users.
9. Termination
You may stop using the Service and request deletion of your account at any time; see Privacy Policy for what deletion covers. We may suspend or terminate an account that breaches these terms, that submits knowingly false applications, or that puts the Service or its third-party integrations at risk. Applications already submitted to an employer cannot be recalled by us.
10. Liability
To the maximum extent permitted by law, MarkKings Group LLC is not liable for indirect, incidental, special or consequential damages, or for lost opportunities, lost employment, or damage to reputation arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100. Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits.
You agree to indemnify MarkKings Group LLC against claims arising from content you submitted through the Service, from applications you approved, and from your breach of these terms.
11. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Florida.
