Terms of Service, version 2026-10-19a
This is an earlier version of the Terms. This page shows the final wording of version 2026-10-19a, as it read when the next version replaced it. For some versions we made edits while the version was current, without giving it a new version number, so the words you saw on an earlier date may differ from this page. To ask for the exact wording we have on record for a particular date, email support@kivooapply.com and tell us the date. This version no longer applies to new purchases. Read the current Terms.
Version 2026-10-19a was first offered on October 19, 2026. While it was current we made two changes without giving it a new version number. On October 27, 2026 we changed one sentence, about Free plan credits being one time and paid plans being sold only in the United States, Canada, Australia and South Africa. On October 28, 2026 we added the Trial pack section. This page shows the wording after both changes. The date at the top of this page, October 28, 2026, is the date in that final wording.
Terms of Service
Effective October 28, 2026. Operated by MarkKings Group LLC.
These terms are the agreement between you and MarkKings Group LLC (“we”) for your use of Kivoo Apply(the “Service”). By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.
1. What the Service does
Kivoo Apply helps you find jobs, tailors your resume and cover letters using AI, drafts recruiter outreach and interview preparation, and can complete and submit job applications on your behalf to third-party application systems.
The last part matters most. When you approve a submission, the Service fills in and submits an application form to an employer or an applicant tracking system in your name, using the contact details, work history and answers held in your account. That employer receives it as an application from you, not from us.
2. Your approval is required before anything is sent
No application is submitted to a third party without your explicit approval of that specific application. The Service performs a series of automated safety checks before an application can be approved, and it refuses to submit when a check fails: when the resume file is missing, when the application form could not be found or read, when required questions are unanswered, or when the target page does not match the job it claims to be.
These checks reduce mistakes. They do not eliminate them. You are responsible for reviewing what you approve.
3. Your responsibilities
- Accuracy. Everything you upload (resume, work history, answers to screening questions) must be true. The Service is instructed not to invent employers, titles, dates, metrics or qualifications, and flags gaps rather than filling them. It cannot verify that what you gave it is true.
- Eligibility. You must be at least 18 years old, which is above the minimum age of 16 (or the higher local age of digital consent) that applies in many countries, and legally able to enter this agreement.
- Your account. Keep your password and any multi-factor credentials secret. Activity under your account is treated as yours.
- Third-party rules. Employers, job boards and applicant tracking systems have their own terms. You are responsible for complying with them. The Service submits automatically only to sources that our configuration allows. For other sources it stops and leaves that step to you. The obligation to follow a source’s rules is ultimately yours.
4. What you may not do
- Submit applications containing statements you know to be false.
- Apply on behalf of anyone other than yourself, or create accounts for other people without their consent.
- Use the Service to send unsolicited bulk messages to recruiters or anyone else.
- Attempt to bypass the approval gate, the rate limits, or the usage quota.
- Resell, sublicense or provide the Service to third parties as your own.
- Attempt to access another user’s data, or to disrupt or probe the Service’s infrastructure.
5. AI-generated content
Resumes, cover letters, outreach messages and interview notes are produced by large language models operated by third parties. Model output can be wrong, awkward, or subtly inaccurate about your own background, and two runs on the same input can differ. Review every document before you approve it. You own what you send; we do not warrant that generated content is accurate, complete, or suitable for any particular application.
As between you and us, you own the content you provide and the documents generated from it. You grant us the licence needed to operate the Service: to store your content, send it to the AI providers described in our Privacy Policy, and submit it to the employers you approve.
6. Usage limits
Each account has a ceiling on AI usage, measured over a rolling 24-hour window in both number of requests and provider cost. When you reach it, generation is refused with a message saying which limit was reached, and it resumes as the window rolls forward. Limits may be changed, and paid plans may carry different ones.
7. Plans, credits and billing
7.1 Plans
Kivoo Apply has a free plan and paid plans. Paid plans are sold monthly or yearly, as shown on our pricing page and again at checkout. The plan, the price, how often you are charged and the renewal terms are shown to you before you pay. Prices are in US dollars. Prices may include, or have added to them, VAT, GST or a similar tax where the law requires it. Any such tax is shown at checkout before you pay.
We charge you through a payment processor. We do not see or store your full card number.
7.2 Your agreement before you pay
Before we charge you, we show you the price, the billing period, that a plan renews automatically, how to cancel, and our refund rules. You must tick a box to confirm that you have read these Terms and the Refund and Cancellation Policy before the Pay button works. We keep a record of your agreement, including the date and time and the version of the wording you saw.
7.3 Automatic renewal
Paid plans renew automatically. A monthly plan renews every month, and a yearly plan renews every year, on the date you first paid, until you cancel. At each renewal we charge the payment method on file the price then in force. Credit packs are one-time purchases. They do not renew.
7.4 How to cancel
You can cancel a plan online at any time. Open the Billing page in your account, select Manage billing, and choose the option to cancel your plan. You do not need to contact us, call anyone or give a reason. If you cannot cancel online, write to legal@kivooapply.com and we will cancel it for you.
Cancelling stops the next renewal charge. For a monthly plan, you keep your plan until the end of the month you have paid for. For a yearly plan, see the refund rules below. If you do not want to continue with a plan, we advise you to cancel it before the renewal date. We do not cancel a plan for you because you stopped using it.
7.5 Refunds
Our refund rules are set out in the Refund and Cancellation Policy, which is part of these Terms. In summary:
- Credit packs are not refundable once purchased, except that a pack paid for while your plan is not active and set to renew is refunded automatically and its credits are not added.
- Monthly plans are not refundable. Cancelling stops the next charge and you keep access to the end of the month you paid for.
- Yearly plans can be cancelled at any time. We refund the months that have not yet started, and not the month already started. The Refund and Cancellation Policy explains how to ask for that refund.
These rules apply except where applicable law requires otherwise. Nothing in these Terms takes away a right you have under consumer protection law where you live.
7.6 Credits
- Plan credits. Each paid plan includes a monthly allowance of credits. Unused plan credits do not roll over: your allowance resets at the start of each new month of your plan.
- Purchased credits. Credit packs can be bought only while your plan is active and set to renew. If your plan is cancelled or a payment fails, renew first. Credits you buy in a pack do not expire while your plan is active.
- When a plan ends. When a paid plan ends without renewal, any unused credits, including credits from packs, are frozen. If you renew within 30 days, credits from packs are restored. Your plan's credits restart at the new period's amount. Frozen credits expire after 30 days if you do not renew. Frozen credits cannot be used.
- Using credits. Credits are used when you use features that need them. We use plan credits before purchased credits.
- Failed work. If a generation fails because of a fault on our side, we return the credits used for it.
- No cash value. Credits have no cash value. You cannot sell, transfer or exchange them, and they cannot be redeemed for money except where the law requires.
- Closing your account. If your account is closed or deleted, any unused credits end and are not refunded, except where the law requires otherwise.
7.7 Price changes
We may change the price of a plan or credit pack. A price change does not affect a plan period you have already paid for. If we raise the price of a plan you have, we will email you at least 30 days before the new price takes effect and tell you how to cancel. If you do not cancel before the date, the new price applies from the next renewal.
7.8 Taxes
Where the law requires us to collect VAT, GST, sales tax or a similar tax, we add it or include it in the price and show it at checkout before you pay. You are responsible for any other taxes that apply to you because of your use of the Service.
7.9 Failed payments and suspension
If a renewal payment fails, our payment processor tries the charge again over a period it sets, and may email you. Your plan stays active while it retries. You can update your card in Manage billing at any time. If the payment still cannot be collected, the subscription ends and your account moves to the free plan. Your account and data stay in place under our Privacy Policy, and you can start a plan again at any time. Unused credits are frozen as described in section 7.6. If you renew within 30 days, credits from packs are restored and your plan's credits restart at the new period's amount. A failed payment is not a refund. You remain responsible for amounts that are properly due.
If you dispute a charge with your bank, please contact us first. See the Refund and Cancellation Policy.
7.10 Free plan
The Free plan includes 3 free credits, given one time when you confirm your email, one uploaded resume and no resume builder. We do not add free credits to an account that uses a temporary email address. Free accounts cannot buy credit packs. The free plan has lower limits than paid plans, shown in the app. It costs nothing and we do not ask for payment details to use it. We may change the free plan, limit it, or end it, with notice to registered users. AI help on the Free plan has a daily limit shared by all Free accounts; when it is used up, it resumes the next day. How AI providers handle your content is described in our Privacy Policy.
7.11 Complimentary accounts
We sometimes give an account a plan or credits at no charge (a complimentary account), for example for a trial, a partner or a promotion. A complimentary account is a gift. It has no cash value, is not refundable, cannot be transferred, and is not charged for. We may end it, change it, or move it to the free plan at any time, and we will tell you if we do. These Terms still apply to a complimentary account. If we later ask you to start paying, nothing is charged until you agree to a paid plan at checkout.
7.12 If a law gives you more
The Service is offered worldwide. If you are a consumer in the EU, the EEA or the UK, you have a 14 day right to withdraw from a digital service. By ticking the box at checkout you ask us to start the service immediately, and you acknowledge that you lose that right once the service is fully performed or your credits are used. Within 14 days, a purchase you have not used is refundable on request where the law requires it. The Refund and Cancellation Policy explains how to ask. Nothing in these terms limits rights you have under mandatory consumer law where you live.
7.13 The one-time Trial pack
The Trial pack is a one-time offer on the Free plan. “One time only” means once for each email address and once for each card, not once for each account. Email addresses that differ only by capital letters, by a plus tag (such as name+1@example.com), or, for Gmail, by dots, count as the same address. Deleting your account and opening a new one does not make you eligible again: for 24 months after an account that bought the Trial pack is deleted, we keep two one-way codes, one made from the email address and one from the card, only to apply this rule, as our Privacy Policy explains. If a Trial pack is bought again with an email address or card that has already been used for it, we refund the payment in full automatically and add no credits.
8. No guarantee of a job
We do not promise interviews, responses, or employment. We do not control whether an employer reads, responds to, or acts on an application. Nothing in the Service is legal, immigration, or career advice.
9. Availability and changes
The Service is provided as-is and as-available. It depends on third-party AI providers, job boards and applicant tracking systems, any of which can change, rate-limit us, or go down. We may modify or discontinue features. Changes to prices and plans are covered in section 7. If we make a material change to these terms, we will update the effective date above and notify registered users.
10. Termination
You may stop using the Service at any time, cancel a paid plan as described in section 7.4, and request deletion of your account; see the Privacy Policy for what deletion covers. We may suspend or terminate an account that breaches these terms, that submits knowingly false applications, or that puts the Service or its third-party integrations at risk. Applications already submitted to an employer cannot be recalled by us.
11. Liability
To the maximum extent permitted by law, MarkKings Group LLC is not liable for indirect, incidental, special or consequential damages, or for lost opportunities, lost employment, or damage to reputation arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100. Some jurisdictions do not allow these limits, in which case they apply only as far as the law permits.
You agree to indemnify MarkKings Group LLC against claims arising from content you submitted through the Service, from applications you approved, and from your breach of these terms.
12. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Florida.
13. Reviews you choose to share
- One review each. Each account can leave one review of Kivoo Apply. You can edit it at any time.
- Your choice to publish. If you tick the consent box, we may show your review on our website with the name and job title you chose and the month and year you wrote it. If you do not tick it, your review stays private and we use it only to improve the Service.
- Withdraw any time. You can withdraw your consent in the app. We take a withdrawn review off our website within 5 minutes.
- How we choose what to show. We show a selection of 4 and 5 star reviews that their authors agreed to share and that pass our automated checks. Only verified users who have used the Service can publish. We never pay for reviews or offer anything in return for them. We read lower ratings and follow up with the author privately. We may remove a review that breaks our rules, such as one that shows personal details.
- Your content. Keep a review to your own experience. Do not include other people’s personal details, links or anything unlawful.
